  • A Conveyancer is responsible for the legal process of buying and selling property. You should hire a licensed conveyancer once you’ve decided you will be putting your house on the market for sale, made an offer on a property or have had your offer accepted. A conveyancer's role is to help with the settlement and title transfer process to ensure their client fully understands their legal obligations. They will be vital for the sale or purchase to run smoothly and will ensure your rights are protected throughout the transaction.

  • The legal work involved in preparing the sales contract, mortgage and other related documents, is called conveyancing. While you can do your own conveyancing, most people engage a licensed conveyancer. In NSW, conveyancers must be fully qualified, trained and licensed with NSW Fair Trading. You are going to want to seek independent legal advice when buying or selling just so you are 100% understanding of the legal obligations you will be entering into.

  • Registering your property means informing the Land Registry Service or LRS of whether your property is subject to a number of legal rights, e.g. mortgages, leases, easements, etc. The Land Registry’s register is comprised of three sections:

    · The property register (describes the land, e.g. whether the title is freehold or leasehold, Lot and DP);

    · The charges register (sets out any third party rights over the land); and

    · The proprietorship register (states who owns the land).
